Welcome to CyndyKelsoArt, also referred to as CK or CKA, US or WE. The CKA website (the "site") is comprised of various web pages operated by CKA. CKA is made available to you on your acceptance without modification of the terms, conditions and notices contained in these Terma and Conditions (the "Terms"). Your use of CKA constitutes your agreement to all such Terms. PRIVACY. Your use of CKA is also subject to the privacy policy contained on the website and in these Terms. Please review our Privacy Policy which governs the Site and informs users of our data protection practices.
NO UNLAWFUL OR PROHIBITED USE/INTELLECTUAL PROPERTY
You the User are granted a non-exclusive, non-transferrable, revocable license to access and use CKA strictly in accordance with these Terms of use. As a condition of your use of the Site, you warrant that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, or impair the Site or interfere with any other party's use and enjoyment of the Site. These Terms of Use do not grant you any intellectual property license or rights in or to the Software and the Website or any of its components or contents, except to the limited extent that these Terms of Use specifically sets forth your license rights to it. CKA does not grant you any licenses, express or implied, to the intellectual property of CKA or our licensors, except as expressly authorized by these Terms.
USER REPRESENTATIONS
By using the Site or Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Use; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Services through automated or non-human means, whether through a bot, script or otherwise; (6) you will not use the Services for any illegal or unauthorized purpose; and (7) your use of the Services will not violate any applicable law or regulation.

You may be required to register with CKA to acess or communicate with CKA. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable, In the event information supplied to CKA is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

This law only applies if CKA establishes a 'business relationship' with you as a 'customer'. A business relationship must have been established by two-way communication with the business and the consumer for Shine the Light to apply. CKA does not sell art works, photographs, or other items directly to the 'customer'. Furthermore, CKA does not collect personal informaton for Direct Marketing purposes; hence no 'business relationship' is established, and the law does not apply.
You may find information on the webiste that will direct you to a 'third party' and any disclosure by you of your personal information to that 'third party' may establish a 'business relationship' with that party. CKA does not ask any third party for that information. It is the policy of CKA that it will not disclose personal information about consumers to third parties for their direct marketing purposes without consent. If in the future, CKA establishes on the webiste a method for collection of personal information, this policy may be modified.
